Terms and conditions of online shopping at SLF24.ie

SMART LINE FURNITURE 24 online shop, available at https://slf24.ie/ is operated by Smart Line Furniture Limited 14A Fairlands. Summerhill Road Dunboyne A86NY57.

These Terms and Conditions set out the rules for the conclusion and performance of a contract of sale of goods ("Contract of Sale") on the website of the Online Store and together with the Privacy Policy constitute the entire contract between the Customer and SLF24. The object of sale shall be the goods presented by the Online Shop on the website at the time of placing an order.

By purchasing through the Online Shop you agree to the terms of the agreement presented in these Terms and Conditions and the Privacy Policy.

Definitions

"Online Shop" or " Shop" means the shop provided by Smart Line Furniture 24 accessible online via https://slf24.ie/.

"Website" means the page available online via the address https://slf24.ie/.

"Blog" means the website available via https://slf24.ie/blog.

"Customer" and/or "Buyer" means the person and/or entity browsing the Online Shop, the Website, and/or Blog or buying through the Online Shop. A Customer of the Online Shop may, but not necessarily also be a "Consumer", i.e. a natural person making a legal transaction with an entrepreneur which is not directly connected with his/her business or professional activity. In the case of a Customer who is a Consumer the provisions on the protection of consumer rights shall apply.

"Goods" means the items purchased by the Customer via the Online Shop.

"Special Goods" means Goods manufactured to the special order of the Customer. The order of Special Goods is possible via the Online Shop or by direct contact with SFL24. The waiting time for Special Goods is extended, which SFL24 informs about during the ordering process.

General provisions

  1. All prices presented in the Online Shop and on the Website are given in euro and include VAT. Prices do include delivery to your room of choice, for any additional services please see charges listed in our Delivery Section available online.
  2. SLF24 reserves the right to change the price of the Goods, to introduce or withdraw Goods, to carry out and cancel promotional campaigns. However, this does not limit in any way the rights acquired by the Buyers.
  3. SLF24 does not carry out direct sales on the Company's premises or in a sales office.
  4. Due to the nature of the Goods sold, the colour patterns, materials, and dimensions featured online may differ from the goods you receive.
  5. In order to use the services of the Online Shop, it is necessary to have devices that allow access to the Internet together with the software necessary for displaying web pages. In order to properly use the Online Shop, the Customer should have computer equipment and software meeting the following minimum requirements: Internet Explorer browser version at least 6.0. or Firefox version at least 2.0., monitor with a resolution of at least 1024x768, Cookies and JavaScript enabled.
  6. SLF24 shall not be liable for any difficulties arising from the availability of the Online Shop, the Website, or the Blog, but shall make every effort to ensure the smooth functioning of the aforementioned resources.
  7. The Customer is obliged to ascertain that the ordered item will fit in the place of delivery (house, flat, other property).
  8. SLF24 shall not be liable for non-performance or improper performance of the services provided on the Website and/or Online Shop if this is caused by third parties, in particular telecommunication operators, providers of telecommunication links, and electricity.
  9. The Customer shall be liable for its own acts or omissions for the acts or omissions of another entity that it enables to use the Service through its own account in the Online Shop.
  10. The Buyer shall become the owner of the Goods upon delivery of the Goods and payment of the price including delivery costs.

Small differences in goods

  1. SLF24 will take reasonable care to ensure that the representations and descriptions of the Goods appearing on our Website are correct. SLF24 has made reasonable efforts to represent the appearance/colour/texture/finish of our goods as accurately as possible. However, the Customer acknowledges and accepts that there may be slight differences between the actual goods and the way they appear on our website. For example, colour tones may vary, due to, among others, screen resolution or quality of equipment or internet connection. If the Customer has any doubts about the colour or texture of the ordered furniture, SLF24 enables the ordering of material samples.
  2. The Customer acknowledges that fabrics may vary slightly in colour and shade. Accordingly, we cannot guarantee that the colour and shade of any goods will be identical to a previous order, sample, or the way the Goods are displayed on our Website.
  3. The label or packaging of the Goods received may differ from their images on our Website.
  4. Furthermore, materials named in a similar manner may be different when reordered and compared; the fabric colour batches can vary in shade once compared with the colour named in analogous way.

Placing Orders

  1. Orders made through the Online Shop can be placed 24 hours a day.
  2. The Buyer warrants that his order and any other information you provide to us is correct and will promptly notify us of any changes to both the order and personal information relating to the order.
  3. To place an order, the Buyer should add the goods of his choice to the product basket and then indicate in the basket the method of payment.
  4. Cost-free cancellation or modification of the order by the Buyer is possible within 7 days from the date of placing the order by the Buyer. For this purpose, please contact SLF24 by e-mail using the address: [email protected] or via the contact form.
  5. The Buyer may choose one of the following methods of payment:
    1. credit card payment via Secure Stripe payment system
    2. payment via PayPal
    3. payment via Klarna.
  1. Before placing the Order, the Buyer shall be informed about the total price for the chosen Goods and Delivery, as well as about all additional costs (including costs of additional services, e.g. transport), which he is obliged to incur in connection with the Contract of Sale. Placing an Order requires acceptance of the Terms of Service and Privacy Policy.

Order processing

  1. As a condition for the fulfillment of an order placed by the Buyer, true personal and contact details must be provided upon registration or when filling in the order form. By doing so, the Buyer consents to the processing of his data for the purpose and to the extent specified in the Privacy Policy.
  2. SLF24 informs the Buyer of possible dates, methods, and costs of Delivery via the website or in a dedicated message.
  3. Deliveries of goods purchased in the shop SLF24 are carried out only on the territory of France. Goods from our offer are usually delivered to the Customer within 21 working days from the date of correct order placement. The execution of some orders may exceed the above specified time. There are also lines of furniture for which the customer must wait about 4-5 weeks. The order lead time will be confirmed via email. Delivery time is counted from the moment of receipt of payment.
  4. The Shop delivers the ordered Goods through courier companies, and in the case of larger orders through carriers who cooperate directly with the manufacturer. In the case of Special Goods, courier delivery is between 5 and 14 working days from the date of execution of the Special Goods by SLF24.
  5. In the event that the order cannot be fulfilled, the Buyer will be immediately notified and SLF24 will return the money received from the Buyer as soon as possible. Instead of a refund, the Buyer may agree to an extension of the order processing time.
  6. The Customer receives proof of purchase, i.e. a receipt or a VAT invoice together with the goods or in electronic form.
  7. Good's prices may change from time to time. The price for Goods ordered is as quoted on our Online Shop at the time the order is placed. Any applicable VAT or sales tax is included in any price quoted. We may change the amount of VAT charged if the VAT rate changes unless you have paid for the goods in full by the date of the rate change.
  8. Detailed information on delivery is available in the SHIPPING FORMS tab on the web page of the Online Shop.
  9. SLF24 will keep the customer informed of any changes to the order via email.
  10. During the delivery of the Goods by the courier company, the Buyer is obliged to check, in the presence of the courier, whether the consignment has not been damaged in transit. In the case of damage to the consignment, the Buyer shall make a damage protocol and report it within 24 hours of delivery to the Seller. Lack of damage protocol can significantly impede the Buyer's ability to pursue any claims against the Store or courier company and to determine the person responsible for the damage to the consignment.
  11. Special Goods or certain Limited Edition Goods may require special organizational measures for return. If the Buyer wishes to cancel an order, the Buyer is requested to contact SFL24 as soon as possible in order to avoid additional operational costs associated with cancellation.
  12. If we mistakenly post an incorrect price for any Goods on the Website, we shall not be obliged to supply the Goods at that price, provided that the Buyer is informed before the Goods are dispatched. If the error is discovered before dispatch, the Buyer will be able to choose whether to order the Goods at the correct price, but if not, SLF24 will refund the Buyer's payment in full.

Complaints

  1. The Buyer has the right to lodge a complaint about the purchased Goods.
  2. The Buyer makes a complaint using the complaint form by filling in the fields marked as obligatory in the form available on the Return Policy tab and following the instructions on the indicated page. Additionally, in order to submit a complaint, the Buyer should attach the documentation necessary to process the complaint in accordance with the instructions on the form.
  3. Complaints are dealt with within 14 days of submission, in accordance with the applicable regulations. The Buyer shall be informed by the Seller by phone or e-mail on the manner of its handling.
  4. The Buyer is entitled to claim under the seller's warranty. The Buyer under the warranty may demand
  5. Bring the Goods to a condition consistent with the agreement by repairing them free of charge,
  6. exchange the Goods for a new one (if the repair or replacement are impossible or require excessive costs),
  7. an appropriate reduction of the price,
  8. withdraw from the contract.

Right of withdrawal and return policy

  1. The Consumer has the right to withdraw from the Sales Agreement within 14 days without giving any reason. The deadline for withdrawal from the Sales Agreement expires after 14 days from the day on which the Consumer came into possession of the item or in which a third party other than the carrier and indicated by the Consumer, came into possession of the Goods.
  2. The period for withdrawal from the Sales Agreement shall start from the moment the Consumer takes possession of the Goods.
  3. To exercise your right of withdrawal from the Sales Agreement, you must inform SLF24 of your decision via the return form available on the Return Policy tab and by following the instructions on the website indicated). The detailed return and complaints policy is set out in Appendix 1 to these Terms and Conditions.
  4. The right of withdrawal shall not apply to the Consumer in relation to the Sales Agreement in which the subject of the provision is a non-refabricated item produced to the Consumer's specification or serving to satisfy his individual needs.
  5. In the event of withdrawal, the Consumer is obliged to return the goods in the original condition, unless the change was necessary within the limits of ordinary management.
  6. The Consumer undertakes to return the Goods in their original packaging or other packaging complying with the requirements of the original packaging and to return the Goods in an undamaged condition bearing the costs related to ensuring adequate protection of the Goods.
  7. The costs of delivery containing the returned goods shall be borne by the Consumer.
  8. The Consumer shall return the Goods immediately, within a period not exceeding 14 days from the date of withdrawal from the contract.
  9. In order to properly secure the goods to be returned, SLF24 recommends sending back the returned goods in a secure, original packaging or other replacement packaging providing the necessary security for the returned Goods, together with the sales document, the original completed return form, and other documents attached to the goods (e.g. instructions, warranty, etc.). In the absence of original packaging, the Customer shall be obliged to pack the returned Goods in a manner allowing for their safe transport.
  10. The Buyer may be required to incur operating expenses associated with the order termination. These costs may include, but is not limited to, the following cases:
    1. If the Consumer has chosen a method of delivery of the Product other than the cheapest ordinary method of delivery available at the Online Shop, the Seller shall not be obliged to reimburse the consumer for any additional costs incurred by him.
    2. The Buyer including the Consumer is obliged to bear all costs of returning the Goods. The Seller may deduct the aforementioned costs of returning the Goods from the funds to be returned to the Buyer's account in connection with the termination of the agreement. If the product is returned due to a fault at our end, e.g. a defective product or one not in accordance with your order, then you will not be charged additionally for returning the goods. However, if you wish to simply cancel your order after it has already been delivered, you will be obliged to pay the costs of returning the products. The return costs for each product may vary, as they depend on the value of the entire order. You can access up-to-date return evaluation via XXXXX.
  11. In order to return Goods purchased via the Online Shop, the Buyer shall contact SLF24 in order to make arrangements for the collection of the Goods.
  12. The return of funds for the Goods together with the shipping costs incurred by the Consumer when purchasing the goods will be made by SLF24 within 14 days from the date of withdrawal from the contract by the Consumer. The refund will be made using the same means of payment that were used by the Buyer in the original transaction unless the Buyer agrees to a different solution. SLF24 may withhold reimbursement until it has received the Goods or until it has been provided with proof of return.
  13. The Buyer shall be liable for any reduction in the value of the Goods as a result of using them in a manner beyond that necessary to ascertain the nature, characteristics, and functioning of the Goods. This means that any damage resulting from the misuse of the purchased Goods is the responsibility of the Buyer.
  14. SLF24 is liable for hidden defects according to the legal provisions applicable to the relationship between SLF24 and the Consumer and SLF24 and the Customer who is not a Consumer.
  15. The Customer is obliged to follow the Complaints Procedure in order to communicate effectively on complaints with SLF24.

Discount codes

  1. From time to time SLF24 may offer discount codes. All discount codes refer to the price of the Goods as presented on the Online Shop. Such codes can only be applied to purchases made through the Online Shop account for which the discount code was offered and registered, and are not transferable or exchangeable for cash. Unless otherwise specified: codes (1) are only available for future new orders placed through the Online Shop; (2) cannot be used retrospectively; (3) can only be redeemed once per customer; and (4) expire after 12 months. A Buyer may not use more than one discount code during a single transaction unless we agree otherwise; if we do, the order in which the codes are applied is solely at SLF24's discretion.
  2. SLF24 reserves the right to reject any discount code if we consider it to be used contrary to these terms and conditions. Discount codes are subject to any additional specific terms and conditions that are set out at the time of issue. SLF24 reserves the right to discontinue or otherwise modify discount codes at any time without prior notice.

Special rules for non-consumers

  1. The Buyer must inspect all Goods immediately upon receipt and, if there are any objections, notify us in writing of any damage to the Goods within 24 hours of delivery and within fourteen working days (14 working days) the Buyer must notify us in writing of any grounds on which it alleges that the Goods do not comply with this contract. In the absence of such notice, the goods shall be presumed to be in all respects in conformity with this contract and free from any defect which would be apparent on reasonable inspection and the Buyer shall be deemed to have accepted the Goods accordingly.
  2. SLF24's total aggregate liability for anything (including our own negligence) is limited to the price paid for the goods. Under no circumstances (including our own negligence) shall we be liable for any:
    1. economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings);
    2. loss of goodwill or reputation;
    3. special, indirect, or consequential damages; or
    4. damage to or loss of data
  3. The Customer shall indemnify SLF24 against all claims and liabilities directly or indirectly related to the breach of this agreement.
  4. These Terms and Conditions constitute the agreement and entire understanding between the Customer and SLF24 with respect to the subject matter hereof and supersede any prior communications or agreements between the Customer and SFL24. Both SLF24 and the Customer confirm that there have been no misrepresentations and that neither has relied on any pre-contractual representations. Liability for misrepresentation (excluding fraudulent misrepresentation) in relation to the terms of this agreement is excluded.
  5. SLF24 shall not be liable for any failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by circumstances beyond our reasonable control, including telecommunications failures of third parties.

Liability

  1. Nothing in these Terms and Conditions in any way limits or excludes SLF24's liability for negligence causing death or personal injury or for fraud or fraudulent misrepresentation or for anything which cannot be excluded or limited by law. In this section, all references to us include our employees and agents.
  2. SLF24 will not be liable for any loss or damage caused by us, our employees or agents in circumstances where:
    1. there is no breach of a legal duty towards the Buyer by SLF24 or by any of our employees or agents;
    2. such loss or damage was not reasonably foreseeable (meaning that it was not an obvious consequence of our breach or was not contemplated by the Customer and SLF24 at the time of entering into this contract);
    3. such loss or damage was caused by you, for example, by Customer’s failure to comply with this Agreement; or
    4. such loss or damage is business-related (as we do not intend that goods purchased by Consumers will be used for business purposes).
  3. The Customer will be liable to us for any reasonably foreseeable loss or damage that we suffer as a result of your breach of this agreement (subject of course to our duty to mitigate any loss).
  4. SLF24 shall not be liable for any failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by circumstances beyond our reasonable control, including telecommunications failures of third parties.

Data Processing

  1. By filling in the registration form in the Online Shop, the Buyer declares that the data provided in it are correct and consents to their processing. SLF24 is obliged to process personal data in accordance with adequate laws and regulations.
  2. The Buyer has the right to inspect his personal data, the possibility to correct and delete it. SLF24 provides each Buyer with the right to control data processing in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) - hereinafter referred to as „GDPR”.
  3. Personal data is processed under the conditions and in the manner specified in the Shop's Privacy Policy.

APPENDIX 1

COMPLAINT/RETURN PROCEDURE

In order to make a claim for Goods purchased via the Online Shop provided by SLF24, please follow the steps below.

  1. Filling in the form available at https://slf24.ie/return-policy. In addition, SLF24 requests photographic documentation and a written description in order to better assess the extent of the reported defect.
  2. The Buyer shall read the instructions explaining how to make a complaint or return and shall provide, by means of the form, correct personal data including contact details enabling SLF24 to identify the applicant and to contact him regarding the reported defect.

SLF24 undertakes to deal with the complaint within 3 working days of the effective date of notification. As a result of a successful request, SLF can offer the following services:

  1. To provide a repair service to rectify a defect in the Goods purchased on-site (at the place of delivery of the Goods as ordered);
  2. To supply a replacement part, the replacement of which will rectify the defect reported by the Customer;
  3. The granting of a discount due to the inconvenience experienced by the Customer as a result of receiving Goods with a defect;
  4. Making a refund and collecting the defective Goods from the Customer.
